Terms & Conditions – Legal Notice and Terms of Use
By purchasing body armor or related products (“item(s)”) from Advanced Firearm Accessories, LLC (DBA BulletproofEveryone.com) (“Company”), you (“Purchaser”) agree to the following Terms & Conditions. These Terms are binding upon purchase.
1. Eligibility & Legal Compliance
1.1 Purchaser affirms that they are at least 18 years of age, or the age of majority in their jurisdiction, whichever is greater.
1.2 Purchaser affirms that they are not a convicted felon, are not legally prohibited from purchasing or possessing body armor, and will use the item(s) solely for lawful purposes.
1.3 Purchaser affirms that their purchase does not violate any federal, state, or local law.
1.4 If located in Connecticut, Purchaser understands that online sales are restricted and civilian purchases must occur face-to-face with a licensed dealer, unless Purchaser is a qualifying governmental official or employee.
1.5 Purchaser affirms that no order will be shipped to an international, APO, DPO, or FPO address unless Purchaser is active duty U.S. military, a U.S. State Department employee, or another U.S. government official authorized to receive such items.
2. Competitor Restrictions
2.1 Purchaser affirms they are not a competitor of the Company, nor acting on behalf of a competitor, manufacturer, or distributor of body armor or ballistic products.
2.2 Purchaser agrees that item(s) will not be purchased, obtained, or used for reverse engineering, benchmarking, competitive evaluation, or design replication.
2.3 Any competitor purchase, whether direct or through an intermediary, constitutes a material breach of these Terms. The Company reserves the right to cancel or void such orders without refund and to pursue damages and injunctive relief.
2.4 Such conduct may constitute unfair competition or misappropriation of trade secrets under applicable law, and all rights and remedies are expressly reserved.
3. Export Restrictions
3.1 Purchaser acknowledges that item(s) may be subject to U.S. export control laws, including the International Traffic in Arms Regulations (ITAR) and the Export Administration Regulations (EAR).
3.2 Purchaser agrees not to export, re-export, or transfer item(s) outside the United States without first obtaining all required U.S. government authorizations.
3.3 Purchaser is solely responsible for compliance with all applicable export laws and regulations.
4. Assumption of Risk
4.1 Purchaser understands and agrees that body armor is not bulletproof; it is bullet-resistant. Injury or death may occur if item(s) are struck by gunfire or used improperly.
4.2 Purchaser assumes all risk of use, misuse, or reliance on the performance of the item(s).
5. Limitations & Disclaimers
5.1 All item(s) are sold AS IS and WITH ALL FAULTS.
5.2 The Company disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose.
5.3 The Company is not liable for incidental, consequential, or indirect damages. The sole remedy, if any, is limited to repair or replacement of defective item(s).
5.4 No oral statements, representations, or assurances shall be binding unless in a written agreement signed by the Company.
6. No Modification & Testing Disclaimer
6.1 Purchaser agrees not to alter, modify, or tamper with the item(s). Any modification voids all disclaimers and releases the Company from liability.
6.2 Purchaser agrees that independent testing of the item(s) is performed solely at Purchaser’s risk and expense. The Company bears no responsibility for injuries, damages, or claims arising from such testing.
7. Force Majeure
The Company shall not be liable for delays, non-performance, or damages caused by events beyond its reasonable control, including but not limited to acts of God, natural disasters, labor disputes, government actions, raw material shortages, or carrier delays.
8. Dispute Resolution & Governing Law
8.1 Purchaser agrees that these Terms are governed by the laws of the State of Washington or Nevada, at the Company’s sole discretion, without regard to conflict-of-law principles.
8.2 Purchaser agrees to first attempt to resolve any dispute by negotiation. If unresolved, the matter shall be submitted to mediation in accordance with statutory rules.
8.3 If mediation fails, the dispute shall be resolved by final and binding arbitration under the rules of the American Arbitration Association. Judgment on the arbitrator’s award may be entered in any court of competent jurisdiction.
8.4 In any dispute arising under these Terms, the prevailing party shall be entitled to recover reasonable attorney’s fees and costs.
9. Indemnification
Purchaser agrees to indemnify, defend, and hold harmless the Company, its members, managers, employees, and affiliates from any claims, damages, liabilities, or costs arising from Purchaser’s purchase, possession, or use of the item(s).
10. Legal Notice
10.1 Illegal purchase, possession, or use of body armor may result in severe legal consequences, including incarceration.
10.2 The Company will fully cooperate with criminal investigations and law enforcement authorities.
11. Miscellaneous
11.1 If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force.
11.2 These Terms may be updated, revised, or changed by the Company at any time without prior notice.
11.3 Bulletproof Everyone® is not affiliated with Carhartt®. Carhartt® does not contribute to the manufacture of our ballistic systems. Carhartt®-brand garments used as carriers offer no ballistic protection.
